| Details | Nikah Registrar is neither a Government servant nor he is in the service of the Republic but he is a public servant. The office of the Nikah Registrars was created under section 4 of the Muslim Marriages and Divorces (Registration) Act, 1974. They shall function under licence from the Government. Section 4 provides that “for the purpose of Registration of Marriages under this Act, the Government shall grant licences to such number of persons, to be called Nikah Registrar.” Provisions of the Muslim Marriages and Divorces (Registration) Act and the Rules made thereunder irresistibly show that a Nikah Registrar is a public servant.
