Title | Kabinnama |
Details | Kabinnama is a marriage settlement; a deed of dower in a Mohammadan marriage. If the marriage is otherwise valid, the mere absence of a written, kabinnama or want of its registration does not render the marriage invalid. [Md. Chan Mia vs. Rupnahar, 18 BLD (HCD) 31] The Muslim marriage being a socio- religious contract between a man and woman, signatures of both the parties in the Kabinnama are essential for proving marriage. No amount of oral evidence can cure this basic deficiency. [Khodeja Begum and ors. Vs. Sadeq Sarakr, 18 BLD (HCD) 31] |
