Details | Apology is an admission of wrong or error by an expression of regret. Under the first proviso to Section 3 of the Contempt of Court Act, 1926 the accused may be discharged or the punishment awarded may be remitted on apology being made to the satisfaction of the Court.
Apology is an act of contrition. When a contemnor tenders apology as an act of contrition the Court must weigh that apology and if it is found to be a real act of contrition, no action need be taken. [Shamsur Rahman, DIG of Prisons vs. Tahera Nargis Syed, 44 DLR (AD) 237].
