Details

Succession means the passing of property or legal rights after death. Commonly refers to the distribution of property under intestate succession laws, which determine who inherits property when someone dies without a valid will. In other words, the process of transferring the assets of a deceased person to the persons entitled to receive those assets.

“Succession” includes both intestate and testamentary succession. [Section 2(26) of the State Acquisition and Tenancy Act, 1950 (E.B.Act XXII of 1951)]

The date of death of the daughter of the propositus, whether it was before or after the coming into force of the Ordinance (MFLO, 1961) is immaterial. It is the date of opening of succession which is of material importance. [Sheikh Ibrahim vs. Nazma Begum 44 DLR (AD) 276]
