TitleUnliquidated Damages
DetailsUnliquidated damages means the damages that are sufficiently uncertain. They are not mathematically calculable and subject to a contingency which makes the amount of damages uncertain. Unliquidated damages are not liquidated; not exactly ascertained; not adjusted or settled. There is a string of authorities holding that unliquidated damages are not an ascertained sum of money within the meaning of rule 6 of Order VIII. [U. L. A. Pak. Ltd. vs. Ehram Jute (1975) 27 DLR (SC) 170]
