Details | Failure to perform the obligations under the contract. Breach of contract occurs where that which is complained of is a breach of duty arising out of the obligations undertaking by the contract. [Jarvis v. Moy, Davis, Smith (1936) 1 KB 399] For any alleged breach of contract the remedy lies in the Civil Court because it involves determination of questions of fact. [Md.
