Title | Same transaction |
Details | The expression 'same
transaction' has not been defined [section 235 of Code of Criminal Procedure,
1898], but judicial pronouncements have set forth a test for determining when
various acts committed by an accused constitute same transaction. The real and
substantial test for determining whether several offences are connected
together so as to form one transaction depends upon whether they are so related
to one another in point of purpose or as cause and effect as to constitute one
continuous action. ( K. M. Zaker Hossain Vs. The State, 1977, 6 CLC (AD) [928] ) |
