Details | The question of sentence is
in the discretion of the Court which finds the accused guilty on a certain
charge. The said discretion, of course, is to be exercised in a judicial manner
on taking all the relevant circumstances into consideration and the trial court
and the Court of first appeal are the appropriate courts to exercise this
discretion. The Supreme Court, generally, does not interĀfere with the legal
sentence imposed by the trial court or the Appellate Court except in
exceptional circumstances. ( Yusuf Sk. alias Sk Abu Yusuf Vs. Appellant TribuĀnal and another, 1977, 6 CLC (AD) [924] ) |
