The Constitution of Bangladesh, 1972, Article 102
Mere an omission to write the word appeal in the application cannot be a ground for not treating that application as an appeal.
Though the caption of the application filed by the writ petitionerdid not state the word "appeal" but for all practical purposes this application was filed by way of appeal after the order of dismissal and that merely an omission to write the words "appeal" under regulation 59 could not make the said application a barren one. ………………………………………………………(12)

Application of writ jurisdiction in cases under the Bankruptcy Act, 1997
The writ jurisdiction is not maintainable in cases under the Bankruptcy Act, 1997 for two reasons- Firstly, the Bankruptcy Act, 1997 is a special law and special provision is provided in section 96 of the Act for preferring appeal against the Judgment and decree passed by the Bankruptcy Court. Secondly, whether notices/summons were properly served or not or whether the petitioner was a guarantor/a mere shareholder of the borrower company or borrowed money from the bank or not which are disputed question of facts and for which remedy lies in the Civil Court and not under summary Writ Jurisdiction…………………………….(8)Sadiul Alam Vs.
