Power to suspend employee employer-

The order of suspension by the Corporation against the employee does not suffer from any infirmity

An employer has the power to suspend temporarily an employee when the employee's conduct has been such as to demand an enquiry, from the discharge of his function until the enquiry has been completed. This power of an employer to suspend an employee can only be questioned in exceptional circumstances.

Where the authority empowered to suspend does not apply its mind to the allegation against the employee and does not indicate what action is proposed to be taken by the employer and keeps on the employee hanging in suspend the matter may call for scrutiny.

In the instant case the Corporation has found rightly or wrongly the allegations against the petitioner to be serious. The order of suspension spells out the allegations, indicates the action that is proposed to be taken, namely dismissal from service, by the Corporation and has also given an opportunity to the employee to explain his conduct…….(7)

Owner of abandoned property has no legal authority to transfer the property-

An abandoned property within the meaning of the Presidents Order No. 16 of 1972 means-

any property owned by any person who is not present in Bangladesh or whose whereabouts are not known or who has ceased to occupy, supervise or manage in person his property.

The power to treat a property as an abandoned property is limited-

The mere service of notice on will not make any property as an abandoned property within the meaning of President's Order No.16 of 1972

By the very definition of the "abandoned property" and the authority concerned cannot treat each and every property as an abandoned property and this power cannot be exercised for all time arbitrarily. It was an emergency legislation for the control, management and disposal of certain properties necessitated by the situations then prevailing in the country and the situations have changed so much in the subsequent years from the situations prevailing in February, 1972 when the President's Order No. 16 of 1972 was promulgated that the Government has to be cautious to intimate proceeding under President's Order No. 16 of 1972. So as to take properties which were not abandoned within the meaning of abandoned properties…….. (5 &7)
