An event or state of affairs known to have happened or existed. A circumstances or incident relating to a case which is being heard.

“Fact” means and includes- (1) anything, state of things, or relation of things capable of perceived by the senses; (2) any mental condition of which any person is conscious. [Section 3 of the Evidence Act, 1872]
