In order to be judicial, a proceeding must relate in some way to the administration of justice or the ascertainment of any right or liability and all proceedings of a judge are not necessarily judicial. Judicial proceeding includes any proceeding in the course of which evidence is or may be legally taken on oath. [Section 4(m) of the Code of Criminal Procedure (Act V of 1898)]

Under Paragraph 962 of the Jail Code, a prisoner under 21 is considered as juvenile and such a prisoner should be kept separated from the adult prisoners. Under paragraph 963 of the Jail Code, the confinement of juvenile offenders in jail is objectionable for many reasons. - Prisons Act, 1894, Section 27(2) and Jail Code.
